On February 17, 2009, Forward Foods LLC (the "Debtor") filed a voluntary petition for relief under chapter 11 of title 11 of the United States Bankruptcy Code (the "Bankruptcy Code"). The case is currently pending in the United States Bankruptcy Court for the District of Delaware (the "Bankruptcy Court") and is being administered under case number 09-10545.

On October 30, 2009, the Debtor filed its Disclosure Statement for its Plan of Reorganization. On November 24, 2009, an Order was entered approving the Disclosure Statement and scheduling a hearing on confirmation of the Debtor's Plan of Reorganization for December 23, 2009 at 11:00 a.m. (Eastern Standard Time).
